Breakthrough in Montenegro on SkyECC evidence - A victory for the rule of law!

The Appellate Court of Montenegro delivered its decision to quash the first instance judgement in which SkyECC materials were accepted as admissible evidence.


As it was established in this decision, the first instance court has not given any valid reasons on admissibility or inadmissibility of this type of evidence, no reasons were given on the fact how was this material obtained, what is the legal nature of this material, it’s compliance with domestic law and it’s compliance with international standards.


We find this decision a validation of our claims that this material can’t be used in courtrooms as admissible evidence since so many preconditions for it haven’t been met, simple as that!
