Our co-founder Bojana Franović gave an interview to the media regarding SkyECC cases in Montenegro and overall situation in judiciary.


The question of admissibility of SkyECC material is yet to be answered and there is a long way ahead of us. The integrity of the data cannot be verified because of the simple fact that the source of the material was never given to the Montenegrin authorities, and therefore neither the defense lawyers have access to it. This situation alone makes it impossible to follow the standards set by international courts in cases from European Court of Human Rights (EctHR) and European Court of Justice (ECJ) regarding procedural safeguards and right to a fair trial, and this is just the beginning.


In order to admit these types of evidence on national level, they must be gathered in accordance with the national law, and this is not the case in Montenegro. The situation gets more complicated because of the pressure from the executive branch of power in Montenegro on the judiciary and of course, the politicians.
